These Terms of Service (“Terms”) govern your access to and use of the Rated R Closet website, online store, products, content, and related services (collectively, the “Services”) operated by Rated R Closet LLC, a Texas limited liability company (“Rated R Closet,” “Company,” “we,” “us,” or “our”).

By accessing our website, purchasing a product, creating an account, participating in a promotion, or otherwise using our Services, you agree to these Terms.

If you do not agree to these Terms, do not access or use the Services.

1. AGE REQUIREMENT

Rated R Closet sells apparel that may contain mature, provocative, controversial, offensive, satirical, or otherwise adult-oriented themes.

Our website is intended for individuals who are 18 years of age or older, or individuals accessing the website with the permission and supervision of a parent or legal guardian.

By accessing or purchasing from our website, you represent that you satisfy this requirement.

2. RATED R CLOSET IS A PARODY AND COMEDY CLOTHING BRAND

RATED R CLOSET IS A PARODY CLOTHING BRAND. OUR PRODUCTS AND DESIGNS ARE CREATED AND SOLD FOR HUMOR, COMEDY, SATIRE, PARODY, ENTERTAINMENT, AND EXPRESSIVE PURPOSES. THEY ARE INTENDED TO MAKE PEOPLE LAUGH AND ARE NOT INTENDED TO BE TAKEN LITERALLY OR SERIOUSLY.

By accessing our website or purchasing our products, you acknowledge and understand that Rated R Closet intentionally creates clothing that may be absurd, provocative, controversial, offensive, shocking, irreverent, exaggerated, dark, or otherwise unconventional as part of the brand's comedic and parody-oriented character.

Unless expressly stated otherwise by Rated R Closet, our designs and products are intended as parody, satire, humor, comedy, social commentary, or other creative expression.

The appearance of words, phrases, images, illustrations, fictional scenarios, cultural references, public figures, brands, characters, events, organizations, activities, or other subject matter on our products should be understood in the context of a parody and comedy clothing brand.

A reasonable viewer should not interpret a Rated R Closet design as a literal or factual statement merely because particular subject matter appears in the design.

OUR DESIGNS ARE NOT INTENDED AS LITERAL STATEMENTS

Unless Rated R Closet expressly states otherwise, our designs are not intended to constitute or communicate:

  • factual claims or representations;

  • genuine endorsements of the people, organizations, conduct, activities, or ideas depicted;

  • instructions or encouragement to engage in conduct depicted as part of a joke;

  • threats or expressions of an actual intent to harm another person;

  • admissions that conduct depicted or referenced actually occurred;

  • professional, medical, legal, political, or other advice;

  • official statements on behalf of any person or organization referenced; or

  • claims that Rated R Closet is affiliated with or endorsed by a referenced third party.

A design may intentionally use exaggeration, absurdity, irony, offensive humor, dark humor, provocative wording, fictional situations, altered imagery, cultural references, or other comedic devices to communicate the joke, parody, satire, or commentary.

The fact that a design depicts, references, jokes about, mocks, exaggerates, or satirizes a particular subject does not mean Rated R Closet endorses or supports that subject.

3. CONTROVERSIAL AND OFFENSIVE HUMOR

Rated R Closet intentionally sells merchandise that some individuals may consider offensive, inappropriate, vulgar, shocking, insensitive, controversial, or in poor taste.

That is an inherent part of the nature of the brand.

Our products are created for customers who understand that comedy, parody, and satire can involve exaggeration, uncomfortable subject matter, provocative language, and jokes that are not intended to be interpreted literally.

By purchasing from Rated R Closet, you acknowledge that:

  1. Rated R Closet is a parody and comedy apparel brand;

  2. its products may intentionally contain controversial or offensive humor;

  3. designs should be viewed within their comedic, satirical, parody, and expressive context;

  4. you may encounter designs with which you personally disagree or find offensive; and

  5. personal offense or disagreement with the message, joke, subject matter, or style of a product does not by itself make the product defective or entitle you to a refund.

Nothing in this section eliminates any rights that cannot lawfully be waived.

4. PARODY, SATIRE, COMMENTARY, AND THIRD-PARTY REFERENCES

Rated R Closet designs may reference or comment upon popular culture, public figures, celebrities, companies, brands, products, fictional characters, entertainment, historical or current events, cultural phenomena, organizations, slogans, imagery, or other recognizable subject matter.

Where such references occur, they may be incorporated into parody, satire, comedy, criticism, commentary, or other expressive works.

Unless expressly stated otherwise, the appearance of a third-party reference does not mean that the referenced person or entity:

  • created the product;

  • approved the product;

  • sponsored Rated R Closet;

  • authorized Rated R Closet;

  • endorses Rated R Closet;

  • is affiliated with Rated R Closet; or

  • agrees with the joke or commentary being made.

Third-party trademarks, copyrights, names, likenesses, and other intellectual property remain the property of their respective owners where applicable.

Rated R Closet does not claim ownership of third-party intellectual property merely because it may be referenced in an expressive work.

5. EXPRESSIVE INTENT

Rated R Closet's products are intended to function not merely as ordinary apparel but also as vehicles for humor, parody, satire, comedy, commentary, and creative expression.

The Company's intent in producing these designs is comedic and expressive.

Rated R Closet believes in the importance of humor, satire, parody, commentary, and freedom of expression. However, nothing in these Terms is intended to declare that every individual design automatically qualifies for a particular legal defense, exception, or constitutional protection.

Whether a particular use constitutes legally protected parody, fair use, commentary, or other protected expression depends upon applicable law and the specific circumstances.

These Terms describe Rated R Closet's intended purpose and the context in which its products are created and presented; they do not alter intellectual-property or other rights established by applicable law.

6. CUSTOMER ACKNOWLEDGMENT OF PARODY NATURE

By purchasing a Rated R Closet product, you expressly acknowledge that you understand you are purchasing merchandise from a parody and comedy clothing brand.

You understand that designs are intended to be viewed in that context and may use intentionally provocative, absurd, exaggerated, controversial, offensive, or shocking material to create humor, parody, satire, or commentary.

If you do not wish to purchase or view merchandise containing this type of content, you should not purchase from or use Rated R Closet.

Rated R Closet is a parody brand. The joke is the point.

7. PRODUCTS

Rated R Closet primarily sells apparel and may offer additional merchandise from time to time.

We attempt to display our products as accurately as reasonably possible. However, actual colors, printing, sizing, placement, materials, or appearance may vary slightly from photographs, illustrations, or digital mockups.

Screen settings, manufacturing processes, garment variations, printing methods, lighting, and other factors can cause differences between online images and physical products.

Reasonable variations that do not materially affect the product's intended use are not considered defects.

8. PRODUCT AVAILABILITY

All products are subject to availability.

We may modify, discontinue, restock, or otherwise change products at any time.

Certain products may be offered as limited releases, preorders, backorders, promotional products, or other special releases.

Availability shown on our website does not guarantee that an item will remain available until an order has been accepted and processed.

9. PRICING

Prices may change at any time without notice.

Taxes, shipping charges, customs duties, import fees, or other applicable charges may be added to your order.

We reserve the right to correct typographical errors, pricing mistakes, promotional errors, inventory errors, or other inaccuracies.

If an order contains a material pricing or listing error, we may cancel the affected order and refund amounts actually paid for the canceled item.

10. ALL SALES GENERALLY FINAL

ALL SALES ARE FINAL EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS OR AS OTHERWISE REQUIRED BY APPLICABLE LAW.

Rated R Closet does not generally accept returns because a customer changes their mind, no longer wants an item, dislikes a design after purchasing it, finds a design offensive after purchasing it, or otherwise decides they do not want the product.

Exceptions are provided for qualifying:

  • sizing exchanges;

  • defective products;

  • incorrect products sent by Rated R Closet; and

  • qualifying orders that are lost or never delivered.

Nothing in these Terms limits rights that cannot legally be waived under applicable consumer-protection law.

11. SIZE EXCHANGES

If an apparel item does not fit, you may request a size exchange.

The exchange request must be made within seven (7) calendar days after the product is delivered.

To qualify, the item must be returned in substantially the same condition in which it was received and must not have been materially worn, washed, damaged, altered, stained, or otherwise rendered unsuitable for resale, except to the extent necessary to reasonably try the item on.

Customers are responsible for purchasing and paying for their own return shipping label unless Rated R Closet determines otherwise.

Exchanges are subject to product and size availability.

If the requested replacement size is unavailable, Rated R Closet may, in its reasonable discretion and subject to applicable law, provide store credit, an alternative replacement, or another reasonable solution.

12. DEFECTIVE OR INCORRECT PRODUCTS

If you receive a materially defective product or an incorrect product due to an error by Rated R Closet, contact:

You must generally contact us within seven (7) calendar days of delivery and provide reasonably requested information, which may include photographs of the product, packaging, shipping label, or defect.

If we confirm that the product is defective or incorrect, we may provide a replacement or refund, as appropriate.

Normal wear, damage caused after delivery, improper washing, misuse, alteration, accidental damage, or damage caused by the customer is not considered a manufacturing defect.

13. REFUNDS

Rated R Closet generally does not provide refunds.

Refunds may be provided when:

  1. an order qualifies as lost or never arrives;

  2. a product is materially defective and we determine a refund is appropriate;

  3. Rated R Closet determines that exceptional circumstances justify a refund; or

  4. applicable law requires one.

Approved refunds will generally be issued to the original payment method.

Financial institutions and payment processors may require additional time to post a refund after we issue it.

14. LOST OR UNDELIVERED ORDERS

If an order does not arrive, contact us at info@ratedrcloset.com.

We may investigate the shipment with the applicable carrier and may require reasonable documentation or cooperation from the customer.

For qualifying lost or undelivered orders, Rated R Closet will generally provide either:

  • a replacement order; or

  • a refund.

We reserve the right to determine the appropriate remedy based on the circumstances, applicable carrier information, fraud concerns, availability, and applicable law.

15. INCORRECT SHIPPING INFORMATION

Customers are responsible for providing accurate and complete shipping information.

If a customer provides an incorrect, incomplete, or undeliverable address, Rated R Closet will determine, in its reasonable discretion and subject to applicable law, whether an order will be reshipped, replaced, refunded, or otherwise resolved.

Additional shipping costs resulting from customer-provided address errors may be charged to the customer.

16. NO ORDER CANCELLATIONS

ORDERS CANNOT GENERALLY BE CANCELED AFTER THEY ARE SUBMITTED.

Orders may enter fulfillment shortly after being placed.

By completing checkout, you acknowledge that your purchase is final subject to the limited exceptions contained in these Terms and any rights provided by applicable law.

Rated R Closet may nevertheless cancel an order on its own initiative where necessary due to inventory issues, fraud concerns, payment issues, listing errors, legal requirements, or other legitimate business reasons.

If we cancel an order after successfully collecting payment, the applicable canceled amount will be refunded.

17. SHIPPING

Rated R Closet generally aims to ship orders within approximately two (2) days after an order is placed.

This is an estimate, not a guaranteed shipping deadline.

Processing and shipment times may vary because of demand, product availability, limited releases, preorders, production schedules, weekends, holidays, carrier disruptions, weather, emergencies, technical issues, or other unexpected circumstances.

Rated R Closet does not guarantee that an order will ship or arrive on a particular date unless we expressly provide a written guarantee for that specific order.

18. PREORDERS AND BACKORDERS

Rated R Closet may offer preorder or backordered merchandise.

These products may require longer fulfillment periods than ordinarily stocked merchandise.

Any estimated shipping or release date associated with a preorder is an estimate unless expressly identified as guaranteed.

By purchasing a preorder product, you acknowledge that fulfillment may occur after the normal estimated processing period.

19. INTERNATIONAL ORDERS

Rated R Closet may ship products internationally.

International customers are responsible for applicable shipping charges.

Customers are also responsible for customs duties, import taxes, brokerage charges, VAT, tariffs, or other governmental charges imposed in connection with an international shipment unless we expressly state otherwise.

International customers are responsible for determining whether a product may lawfully be imported into their country.

Customs processing may delay international deliveries.

20. RESALE

Customers may generally resell authentic Rated R Closet merchandise they lawfully purchase, subject to applicable law.

Purchasing our products does not grant permission to represent yourself as Rated R Closet, an authorized Rated R Closet retailer, partner, representative, distributor, or affiliate.

You may not reproduce our merchandise or use our intellectual property to manufacture counterfeit or unauthorized Rated R Closet products.

21. PAYMENT AND AUTHORIZATION

By submitting payment information, you represent that:

  • the information provided is accurate;

  • you are authorized to use the payment method;

  • you authorize the applicable charge; and

  • you authorize us and our payment providers to process the transaction.

Payments may be processed by Shopify and other third-party payment providers.

22. FRAUDULENT CHARGEBACKS AND PAYMENT DISPUTES

Customers retain their lawful rights to dispute genuinely unauthorized, fraudulent, undelivered, defective, or otherwise legitimately disputable transactions.

However, knowingly submitting a false or fraudulent chargeback or payment dispute is prohibited.

If a payment dispute is initiated, Rated R Closet may provide information reasonably relevant to the dispute to payment processors, banks, card networks, fraud-prevention providers, or other appropriate parties.

Such information may include, where lawfully available and relevant:

  • order information;

  • transaction records;

  • customer communications;

  • shipping and tracking information;

  • delivery confirmations;

  • account information;

  • device or technical information;

  • IP-related information;

  • acceptance of these Terms; and

  • other evidence concerning the transaction.

We reserve all rights and remedies available to us regarding fraudulent transactions or payment disputes.

23. PROMOTIONS, DISCOUNTS, GIVEAWAYS, AND LIMITED DROPS

Rated R Closet may offer promotions, discount codes, giveaways, contests, limited releases, mystery products, or similar programs.

Additional terms may apply to individual promotions.

We may invalidate participation, orders, discounts, or entries resulting from fraud, automated abuse, manipulation, duplicate entries, technical exploitation, or violation of applicable promotional terms, subject to applicable law.

Unless otherwise stated, discount codes cannot be redeemed for cash.

24. CUSTOMER PHOTOS AND USER CONTENT

Customers may submit, tag, send, or otherwise make available photographs, videos, reviews, testimonials, social-media content, or other material relating to Rated R Closet (“User Content”).

If you directly submit User Content to Rated R Closet, tag or mention Rated R Closet in connection with content featuring our products, or otherwise intentionally make content available to us for promotional interaction, you grant Rated R Closet a non-exclusive, worldwide, royalty-free license to repost, reproduce, display, distribute, and use that content in connection with our website, social media, advertising, promotional materials, and marketing, to the extent permitted by applicable law.

You retain ownership of your original User Content.

You represent that you have the necessary rights to provide any User Content you submit to us.

25. INTELLECTUAL PROPERTY

The Rated R Closet name, logos, original artwork, website materials, photographs, graphics, product designs, branding, text, and other original materials owned by Rated R Closet are protected by applicable intellectual-property laws.

Purchasing a product does not transfer any intellectual-property ownership rights to the purchaser.

You may not reproduce, manufacture, distribute, commercially exploit, or create counterfeit versions of our protected materials without authorization, except where applicable law permits such use.

Rated R Closet may create expressive works involving commentary, humor, satire, parody, or references to popular culture or third parties. Nothing in these Terms claims ownership over intellectual property belonging to third parties.

26. PROHIBITED USE

You may not use our Services to:

  • violate applicable law;

  • commit fraud;

  • submit knowingly fraudulent payment disputes;

  • interfere with website security;

  • introduce malware or malicious software;

  • attempt unauthorized access to systems or accounts;

  • impersonate Rated R Closet;

  • manufacture counterfeit Rated R Closet products;

  • infringe our intellectual-property rights; or

  • use our Services in a manner that materially interferes with their operation.

We may restrict or terminate access for violations of these Terms.

27. THIRD-PARTY SERVICES

Our store may rely upon third parties including e-commerce platforms, payment processors, shipping carriers, analytics providers, social-media platforms, and other service providers.

Those services operate independently and may be governed by their own terms and policies.

To the maximum extent permitted by law, Rated R Closet is not responsible for acts, omissions, outages, policies, or failures independently attributable to third-party services.

28. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE, SERVICES, CONTENT, AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS EXCEPT FOR EXPRESS WARRANTIES WE PROVIDE IN WRITING.

Rated R Closet disclaims warranties that may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes or limits warranties or consumer rights that cannot lawfully be excluded.

29. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RATED R CLOSET LLC AND ITS MEMBERS, OWNERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, REPRESENTATIVES, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE SERVICES, WEBSITE, PRODUCTS, CONTENT, OR THESE TERMS.

To the maximum extent permitted by law, Rated R Closet LLC's aggregate liability arising from a particular order or transaction shall not exceed the amount actually paid to Rated R Closet LLC for the product or order giving rise to the claim.

These limitations apply only to the extent permitted by applicable law.

30. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Rated R Closet LLC and its members, owners, managers, employees, contractors, agents, representatives, and affiliates against third-party claims, liabilities, damages, losses, and reasonable expenses arising from:

  • your unlawful use of the Services;

  • your material violation of these Terms;

  • your infringement of another person's rights; or

  • User Content you submit where you lacked the necessary rights to provide it.

31. BINDING ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except for disputes that applicable law does not permit to be arbitrated, disputes arising out of or relating to these Terms, your use of the Services, or your purchase of products from Rated R Closet shall be resolved through binding individual arbitration rather than a lawsuit in court.

Before initiating arbitration, the party asserting a dispute must provide the other party with written notice describing the dispute and requested relief and allow at least 30 days for the parties to attempt to resolve the matter informally.

If the dispute is not resolved, either party may initiate arbitration.

The arbitration shall be conducted by a nationally recognized arbitration provider under its applicable consumer or commercial rules, as appropriate and subject to applicable law.

Unless the parties agree otherwise or applicable arbitration rules or law require another location or procedure, arbitration shall be associated with Houston, Texas.

The arbitrator may award remedies available under applicable law but shall have no authority to award relief prohibited by these Terms where such limitation is legally enforceable.

Nothing in this section prevents either party from seeking relief in small claims court where the dispute qualifies and applicable law permits.

Nothing in these Terms prevents a party from seeking temporary or emergency injunctive relief where legally available.

32. INDIVIDUAL PROCEEDINGS AND CLASS-ACTION WAIVER

To the maximum extent permitted by applicable law, arbitration under these Terms will take place on an individual basis.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND RATED R CLOSET AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Neither party will seek to have an arbitrable dispute heard as a class, collective, consolidated, or representative proceeding except where such restriction is prohibited by applicable law.

If this restriction is determined unenforceable with respect to a particular claim or remedy, the enforceability and treatment of that claim shall be determined under applicable law.

33. GOVERNING LAW

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where federal law or another applicable law controls.

For disputes that are not subject to arbitration and for which the parties may legally agree upon venue, the parties consent to jurisdiction and venue in courts of competent jurisdiction located in Houston, Texas.

34. FORCE MAJEURE

Rated R Closet will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including severe weather, natural disasters, fires, floods, wars, civil disturbances, governmental actions, carrier interruptions, labor disputes, supply-chain disruptions, internet or infrastructure failures, emergencies, epidemics, pandemics, or similar circumstances.

35. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed as necessary.

The remaining provisions will continue in full force and effect.

36. NO WAIVER

Failure by Rated R Closet to enforce any provision of these Terms does not waive our right to enforce that provision later.

37. CHANGES TO THESE TERMS

We may modify these Terms from time to time.

Updated Terms will be posted on our website with a revised “Last Updated” date.

Changes will apply prospectively from their effective date unless applicable law permits or requires otherwise.

Your continued use of the Services following the effective date of updated Terms constitutes acceptance to the extent permitted by applicable law.

38. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, promotional terms, and other policies expressly incorporated into them, constitute the agreement governing your use of the Services, except where a separate written agreement applies.
