CAL PERSONAL DELIVERY PROMOTION

TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern the Rated R Closet Cal Personal Delivery Promotion (the “Promotion”), offered by Rated R Closet LLC (“Rated R Closet,” “Sponsor,” “we,” “us,” or “our”).

By making a qualifying purchase during the Promotion Period, you acknowledge and agree to these Terms.

1. Promotion Overview

As part of this Promotion, Rated R Closet will select one qualifying customer to receive a personal delivery experience from Cal, the owner of Rated R Closet.

The selected customer will receive:

  • A personal in-person delivery from Cal; and

  • A surprise gift provided by Rated R Closet.

This Promotion is not a random drawing or sweepstakes. The customer receiving the personal delivery will be selected using the location and delivery-logistics criteria described below.

2. Promotion Period

Qualifying purchases must be completed no later than:

September 30, 2026 at 11:59 p.m. Eastern Time.

Orders placed after this deadline will not qualify for this Promotion.

Rated R Closet's records and order-management system will determine the official date and time an order was received.

3. Eligibility

To qualify for consideration, a customer must:

  • Be at least 18 years old at the time of purchase;

  • Be a legal resident of the United States;

  • Provide a valid physical delivery address within the United States;

  • Complete a qualifying purchase directly through the official Rated R Closet website by the deadline; and

  • Comply with these Terms.

P.O. boxes or addresses at which an in-person delivery cannot reasonably occur may not be eligible for personal delivery.

The Promotion is void where prohibited or restricted by applicable law.

4. Qualifying Purchase

A “Qualifying Purchase” means a legitimate purchase of Rated R Closet merchandise completed through the Rated R Closet website during the Promotion Period.

Orders that are fraudulent, canceled, fully refunded, subject to a chargeback, or otherwise invalid may be excluded.

Making additional purchases does not improve a customer's position in the selection process. Each customer will be considered based upon the location and logistical criteria described in these Terms, not based on the amount spent or number of orders placed.

5. This Is Not a Random Drawing

There will be no random drawing, randomized selection, lottery, wheel, random-number generator, or selection by chance.

The selected customer will be determined based upon geographic location and Cal's legitimate personal and/or business travel and delivery schedule.

Customers should not purchase merchandise with the expectation that every purchaser has an equal or random “chance” of receiving the personal delivery.

6. How the Customer Will Be Selected

Rated R Closet will determine the selected customer using the following factors:

Geographic proximity. The customer's delivery address will be compared with locations where Cal is legitimately scheduled or otherwise expected to be during the applicable delivery period.

Existing travel plans. Cal's personal or business travel plans may be considered when determining which customer can reasonably receive an in-person delivery. Travel plans used for this purpose must be legitimate plans and not created for the purpose of favoring a particular customer.

Delivery feasibility. Rated R Closet may consider driving distance, travel time, scheduling, accessibility of the delivery location, safety, and whether an in-person delivery can reasonably be completed.

Timing. The customer's availability and Cal's availability during the applicable travel period may be considered.

These factors are intended to determine which qualifying customer is most reasonably located for the personal delivery, rather than selecting a customer by chance.

7. Location-Based Selection Procedure

After the Promotion Period, Rated R Closet may compare qualifying customer delivery addresses with Cal's documented upcoming travel locations.

Where practical, the customer whose qualifying delivery address is geographically closest to a location on Cal's legitimate travel schedule and for whom the delivery can reasonably be completed will be selected.

Rated R Closet may use commonly available mapping or navigation software to determine approximate driving distance and travel time.

If two or more qualifying customers are effectively equally situated based on location and logistics, the customer whose qualifying order was placed earlier will receive priority.

A random tiebreaker will not be used.

8. Travel Schedule Changes

Cal travels for personal and business reasons, and his schedule may change.

If a planned destination is canceled, postponed, or materially changed before the personal delivery occurs, Rated R Closet may reevaluate qualifying customers using Cal's updated legitimate travel schedule.

Any such reevaluation will continue to use the location and logistical criteria contained in these Terms and will not be conducted randomly.

9. Selected Customer Notification

Rated R Closet will contact the selected customer using the email address, telephone number, or other contact information associated with the qualifying order.

The customer may be required to:

  • Confirm that they are at least 18 years old;

  • Confirm their identity;

  • Confirm their delivery location;

  • Confirm their availability;

  • Provide reasonable information necessary to coordinate the delivery; and

  • Accept these Terms.

The selected customer should respond within 48 hours of being contacted unless Rated R Closet provides a different deadline.

If the customer cannot be contacted, does not respond, is ineligible, declines the delivery, provides inaccurate information, or cannot reasonably participate, Rated R Closet may proceed to the next qualifying customer based on the same non-random location and logistical criteria.

10. Personal Delivery

The exact date and time of the personal delivery will be coordinated between Rated R Closet and the selected customer.

The delivery may occur after September 30, 2026.

Rated R Closet does not guarantee that the delivery will occur on any particular day.

For privacy, security, safety, accessibility, or logistical reasons, Rated R Closet and the selected customer may mutually agree for the delivery to occur at a nearby public or private location rather than directly at the customer's residence.

11. Customer's Order

Where operationally possible, Cal will personally deliver the selected customer's qualifying Rated R Closet order.

If the qualifying order has already been fulfilled or shipped before the customer is selected, Rated R Closet may instead arrange for Cal to personally deliver a separate Rated R Closet package containing the customer's surprise gift and/or additional merchandise.

The customer will not be required to return merchandise that has already been delivered.

Important: if your main advertisement specifically promises that Cal will deliver the customer's actual order, you should either hold the eventual selected order or change the advertisement to “Cal will personally deliver a Rated R Closet package to one qualifying customer” so the ad and these Terms don't conflict.

12. Surprise Gift

The selected customer will receive a surprise gift chosen by Rated R Closet.

The exact contents of the surprise gift are not guaranteed and may remain confidential until delivery.

The approximate retail value of the surprise gift will not exceed:

The surprise gift:

  • Has no guaranteed cash value;

  • May not be exchanged for cash;

  • May not be transferred before delivery; and

  • May be substituted by Rated R Closet with an item of equal or greater approximate retail value if the originally intended item becomes unavailable.

13. No Guarantee Based on Purchase Amount

Purchasing more merchandise, placing additional orders, or spending more money will not provide an advantage in the selection process.

Selection is based on location and delivery logistics as described in these Terms.

14. No Random Odds

Because the recipient is not selected randomly, there are no sweepstakes “odds of winning.”

Whether a customer can be selected depends primarily upon the customer's location relative to Cal's legitimate travel schedule and the feasibility of completing the personal delivery.

15. Photography, Video and Social Media

The selected customer is not required to agree to public filming merely to receive the personal delivery, unless that requirement is clearly disclosed before selection and permitted by applicable law.

Rated R Closet may separately ask the selected customer for permission to photograph or record the delivery.

If Rated R Closet intends to use the customer's name, image, likeness, voice, statements, or video footage for advertising or social-media purposes, Rated R Closet may require the customer to execute a separate written appearance/publicity release before such content is recorded or published.

Declining optional publicity consent will not automatically invalidate an otherwise qualifying customer unless participation in filmed content was clearly made a condition of the Promotion before purchase.

16. Safety and Conduct

Rated R Closet may decline to conduct a delivery at a particular residence or location if there is a legitimate safety, security, legal, or accessibility concern.

Where possible, Rated R Closet will offer the selected customer a reasonable nearby alternative meeting location.

Threatening, abusive, fraudulent, dangerous, or unlawful conduct may result in disqualification.

17. Fraud and Abuse

Rated R Closet reserves the right to exclude a customer who:

  • Uses fraudulent payment information;

  • Provides false eligibility or address information;

  • Manipulates or attempts to manipulate the Promotion;

  • Places fraudulent orders;

  • Engages in chargeback abuse;

  • Attempts to impersonate another customer; or

  • Otherwise materially violates these Terms.

Disqualification will not be based arbitrarily on a customer's identity or simply because Rated R Closet would prefer a different customer.

18. Taxes

Any federal, state, or local tax obligations arising from receipt of the surprise gift or other promotional merchandise are the responsibility of the selected customer to the extent required by law.

19. No Travel Provided to Customer

Rated R Closet will not require the selected customer to purchase airfare, lodging, transportation, or other travel in order to receive the personal-delivery benefit.

Unless Rated R Closet agrees otherwise in writing, the selected customer is not entitled to reimbursement for transportation or other expenses incurred voluntarily in connection with the Promotion.

20. Changes Outside Rated R Closet's Control

Rated R Closet may reasonably modify the timing or logistical details of the personal delivery when circumstances outside its reasonable control make the original arrangements impracticable, including severe weather, travel disruption, illness, transportation problems, government restrictions, emergencies, or similar events.

Any modification will be handled in a manner reasonably consistent with the Promotion as advertised and will not convert the selection process into a random drawing.

21. Limitation of Liability

To the fullest extent permitted by applicable law, Rated R Closet and its owners, employees, contractors, affiliates, and representatives will not be responsible for losses arising from circumstances beyond their reasonable control in connection with the Promotion.

Nothing in these Terms excludes or limits any right or liability that cannot legally be excluded or limited.

22. Privacy

Information provided through a qualifying order may be used as reasonably necessary to administer the Promotion, verify eligibility, contact the selected customer, and coordinate the delivery.

Customer information will otherwise be handled in accordance with Rated R Closet's applicable Privacy Policy.

The selected customer's home address will not be publicly disclosed by Rated R Closet without permission except where disclosure is required by law.

23. Interpretation

These Terms are intended to describe a non-random, location-based promotional customer experience.

Terms such as “winner,” “drawing,” “raffle,” “lottery,” “odds,” “randomly selected,” or “chance to win” should not be interpreted as applying to this Promotion and should not be used in advertising the Promotion.

24. Governing Law

These Terms are governed by applicable federal law and, to the extent applicable, the laws governing Rated R Closet LLC and the jurisdiction in which the Promotion is conducted, without limiting any mandatory consumer protections applicable in a customer's state of residence.

26. Acceptance of Terms

By participating in the Promotion through a qualifying purchase, the customer acknowledges that they have had an opportunity to review these Terms and understands that:
